KLBC Activities Report for May 2017

3 May 2017
Pupils Introduction Session
A monthly tradition, the May’s Pupils Introduction Session was held on 3 May 2017. The session, attended by 91 pupils, was led by Dinesh Muthal. The purpose of the session is to introduce pupils to the structure of the Malaysian Bar and the Kuala Lumpur Bar, the election to both the Bar Council and the Kuala Lumpur Bar Committee (“KLBC”) and the highlights of the Malaysian Bar. It included a session for pupils to raise issues and problems faced by them during their pupillage period. The other executive committee members of the KLBC were also present to provide input and possible solutions. As in previous sessions, the pupils were also shown a video montage of the History of the Malaysian Bar.

Seminar on Wills, Probate, LA and SEDA
Organised by the Corporate & Conveyancing Practice Committee, this seminar was presented by Selva Balan a/l Sinnan, Nahzatul Ain, Ow Hui Ching and Daphne Lew at the KL Bar Auditorium from 10:00 am to 4:30 pm. The seminar was attended by 83 participants. The seminar covered, amongst others, "the basic concept and fundamental of writing a will"; "determining the mode of application"; "processes for obtaining probate or letters of administration of an estate of a person, and small estate"; and "its relevance with conveyancing practice".

5th KL Bar Futsal Competition 2017
This Competition was held at Samba De Futsal, Petaling Jaya on 6 May 2017. A total of 23 teams (20 Men’s and 3 Women’s) participated in the event and the winners were:

Men’s Category
Champion – Morior Invictus
1st Runner Up – Enjoi Troopers
2nd Runner Up – Dark Horses

Women’s Category
Champion – The Outlaws
1st Runner Up – KTT

Men’s Plate Category
Champion – CPD FC
1st Runner Up – ZICO

Men’s Best Player – Krishnamogan

Women’s Best Player – Hanna Meera

Meeting with the KL Courts Administration
This meeting was held at 3:00 pm at the KL Courts. The KLBC was represented by  the Honorary Secretary Muhendaran Suppiah, Committee members namely Atan Mustaffa, Vivekananda Sukumaran, Shashi Devan Thalmalingam, Jacky Loi Yap Loong, Nik Elin Zurina and the KL Bar Representative on the Bar Council Khaizan Sharizad. Among the issues discussed at the meeting were issues relating to the car park and Service Bureau, the condition of the washrooms at the KL Court Complex, the upcoming implementation of Phase 2 of the E-Court  System and matters pertaining to Criminal Law Courts.

Seminar on An Introduction to the New Companies Act 2016 and the Companies Winding Up Petitions
Organised by the Professional Development Committee, this seminar was presented by Alex Chang at the KL Bar Auditorium from 3:00 pm to 6:00 pm. The seminar was attended by 117 participants. The seminar covered, amongst others, "New threshold of issuing a Notice Pursuant to s 218 (now 465 and 466) of the new Act."; "Is a Judgment required prior to the filing of a Companies Winding Up Petition?"; "Definition of Unable to pay its debts"; "Affidavit verifying Petition"; "New Commencement of the  Winding Up"; "Twice or four times Advertisement of the Petition in the Newspapers?"; "Affidavit In Opposition to Petition"; "Appointment of an INTERIM Liquidator, Official Receiver or the (Private) liquidator"; "Costs"; "Interpretation by the Federal Court of the word ‘and'  in s 223  of the old  Companies Act 1965, as  “disjunctively” instead of the usual  “conjunctively”, and now in light of the new section 467 the Companies Act 2016"; "The "Pay Something for Nothing" proposition"; "How a RM74 million Court Judgment in Damages was reduced to nothing?"; and "The journey of both matters from the High Court all the way to the Federal Court".

Social Get-Together 
Organised by the Recreation, Social & Culture Committee, this event was held at MindSpace, 1 Mont Kiara from 7:30 pm onwards. It was a success with a turnout of about 50 lawyers and pupils-in-chambers. Click here to view the photos.

Organised by the Professional Development Committee, this seminar was presented by Lim Kien Chai at the KL Bar Auditorium from 9:00 am to 5:00 pm. The seminar was attended by 61 participants. The seminar covered, amongst others, "The roles of Accounting in the Legal Profession"; "Law & Accounting"; "Accounting vs Finance"; "ABC of Financial Accounting"; "What is Accrual & Cash Accounting & what is the difference & significance"; "Fundamentals & Components of Financial Statements"; "Management Accounting vs Management Account"; "What is Turnover, Gross Profit, Trading Profit, Net Profit, PBT, PAT & Retained Earnings"; "What is the difference between Profit & Cash"; "What is Working Capital & its difference from Solvency & Liquidity"; "How do I read Financial Statements"; "What is Capital Expenditure"; "Why Capital Expenditures increase the Assets Value but Cash Outflows like Salary do not create an Asset & rather it decreases the Equity"; "Capital Expenditure vs Operational Expenses"; "Is it possible for a company to show profit in the financial statement yet the company is in liquidation"; "Accounting & its Extended Family"; and "Vulnerability of Financial Statement & Forensic Accounting".

Organised by the Professional Development Committee, this seminar was presented by Jeremiah R Gurusamy at the KL Bar Auditorium from 2:30 pm to 4:30 pm. The seminar was attended by 77 participants. The seminar covered, amongst others, "What are the essential considerations when entering into a joint venture"; "Key pointers for handling negotiations and dealing with compliance and regulatory issues"; "Critical clauses to be incorporated in a JV and Shareholders Agreement"; and "Exits and termination – What to do if things go wrong".

(Repeat) Seminar on Updates to the Companies Act
Organised by the Professional Development Committee, this seminar was presented by Wong Tat Chung at the KL Bar Auditorium from 3:00 pm to 6:00 pm. The seminar was attended by 119 participants. The seminar covered the Companies Act 2016: The after effects and the relevant subsidiary legislation.

Seminar on Human Rights and The Constitution
Organised by the Professional Development Committee, this seminar was presented by Emeritus Professor Datuk Dr. Hj. Shad Saleem Faruqi at the KL Bar Auditorium from 3:00 pm to 6:00 pm. The seminar was attended by 52 participants. The seminar covered, amongst others, "Concept of human rights"; "Various degrees of entrenchment: Constitution's hierarchical approach to human rights"; "Constitutional rights and restraints"; "Judicial enforcement of human rights"; and "Constitution at the Crossroad".

Organised by the Professional Development Committee in collaboration with the Malaysian Institute of Arbitrators (MIArb), this seminar was presented by Kevin Prakash, Victoria Loi and Karen Ng Gek Suan at the KL Bar Auditorium from 3:00 pm to 6:00 pm. The seminar was attended by 74 participants.
